PRESS RELEASE
WECOSIGN
Prevails in Domain Dispute Before the World Intellectual
Property Organization
October 1, 2010
SANTA ANA, Calif., Oct. 1 /PRNewswire/ -- (OTC Bulletin Board:
WECS) (www.wecosign.com ) – WECOSIGN CIO Carlos Padilla announced
today that an action filed by WECOSIGN's attorneys Knobbe,
Martens, Olson & Bear LLP has resulted in a decision by
an international panel of the World Intellectual Property
Organization (WIPO) ordering the prompt transfer of the domain
name wecosignusa.com to WECOSIGN. In reaching the conclusion
that the domain registrant had registered and used the wecosignusa.com
domain in bad faith, the WIPO panel held that the registrant's
"use of the Disputed Domain Name is likely to cause consumer
confusion, mistake and deception as to the source or sponsorship
of the Disputed Domain Name," and that "it is likely
that a consumer could well believe that the Disputed Domain
Name or content on it has been approved, sponsored, or affiliated
with" WECOSIGN.
"This action was necessary," says Padilla, "to
protect consumers from confusion and from being misled.
This decision confirms that people who register another
company's trademark as a domain name, with the addition
of a generic, geographic, or descriptive term in bad faith
are not legitimate registrants. WECOSIGN values its goodwill
and trademarks highly, and is committing to enforcing its
brand and reputation in cyberspace. WECOSIGN's commitment
extends not only to the constant monitoring of domain registrations
and trademark misuse on the Internet, but also to web sites
hosting defamatory allegations about our business practices."
"In today's world, the Internet is an important party
of any business, and ours is no exception. Enforcing intellectual
property rights online is an ongoing effort that requires
patience and determination. Chasing down the perpetrators
of these internet schemes is like trying to wrap your arms
around smoke," says Padilla. "They simply unplug
from a basement or executive suite operation somewhere and
disappear."
"It remains to be seen whether law enforcement in
cyberspace will ever effectively deter intellectual property
infringement, defamation, and other unlawful online activities.
Until that day, however, WECOSIGN remains determined to
enforce its rights. "We draw the line," Padilla
concludes "when it comes to our business reputation
and integrity."
